New KiwiSaver Rules for Rural NZ
Many rural clients have been unable to use their KiwiSaver for a first home because of their job. If you live in a farmhouse provided by your employer or if you're buying a farm through a company, the old rules didn't work for you.
That is about to change. The Government’s new KiwiSaver Amendment Bill (introduced in mid-2026) is designed to level the playing field for the rural community.
Here is what you need to know
1. The "Service Tenancy" Win
The Problem: Previously, you couldn’t withdraw KiwiSaver unless you intended to move into the house immediately. This blocked farm workers, rural teachers and country police who must live on-site for their jobs.
The Fix: If you are in a service tenancy (employer-provided housing), you can soon withdraw your KiwiSaver to buy a first home without having to live in it.
The Benefit: Build equity in a "town house" or rental property while you keep working on the land.
What you’ll need: A letter from your employer confirming your housing is tied to your employment.
The "First Farm" Rule
The Problem: Most farms are bought through a trust, company or partnership. KiwiSaver rules previously required the title to be in your personal name.
The Fix: You can now use your KiwiSaver to help purchase a first farm through a commercial entity, provided:
You have majority ownership and control of that entity.
The farm will be your principal home.
Note: This applies to agricultural and pastoral land, but generally excludes large-scale commercial forestry.
When do these rules kick in?
Mid-2026: The Bill is being introduced to Parliament and will go through the Select Committee process.
Late 2026: The rules are expected to be fully active.
Implementation: Once passed, KiwiSaver providers will update their forms to allow these new withdrawal types.
